Driver and Partner Terms
These terms are between Nomad Travel & Hospitality Inc., a company based in Ontario, Canada that operates Visby (“Visby”, “we”, “us”), and you, if you provide a service to guests of a hotel that uses Visby: as a driver, or as a business such as a tour or dive operator, rental shop or restaurant (a “Provider”). You accept them when you sign up on a Visby driver page, accept a ride or booking through Visby, or set up payouts with Visby. Hotels have their own Partner Terms.
1. What Visby does
- Visby gives hotels tools to send you rides and bookings, and gives you pages to accept them, update the guest, share your location during a ride, message and call guests and the hotel, and confirm bookings.
- Visby doesn’t provide transport, tours or any other service to guests, doesn’t employ you, and doesn’t decide which rides or bookings you take. You’re free to work with other hotels and platforms.
2. You and the hotel
- The hotel chooses to work with you. What you agree with the hotel (prices, how and when you’re paid, cancellations) is between you and the hotel. Visby isn’t a party to it.
- Fares Visby suggests are suggestions. A ride’s price is the one confirmed in the app.
3. Your responsibilities
- You hold the licences, permits and insurance the law requires for what you do, and keep them valid. Drivers keep their vehicle roadworthy, drive safely and follow local law.
- You give accurate information about yourself, your business and your vehicle, and keep it up to date.
- Your sign-in links and the device you use them on are yours to keep safe. Don’t share a sign-in link. Tell us if you think someone else has used it.
- You’re responsible for the taxes on what you earn.
4. Guests’ privacy
- Use guests’ details only to deliver the ride or booking they made. Don’t contact guests outside Visby or the hotel’s channels, market to them, or keep their details afterwards.
- Guests’ phone numbers and emails, and yours, are not shown to each other. Phone numbers, emails and links typed into ride chats are removed. Don’t try to get around this.
- Don’t record calls or take photos of guests without their permission.
5. Live location
Drivers can share their live location during a ride. It’s off until you turn it on, it stops when the ride ends, when you turn it off, or after your page has been in the background for a while, and only the guest and the hotel for that ride see it. We keep only the latest point for the ride.
6. Calls and messages
- Calls through Visby connect you with guests and the hotel without showing anyone’s number, and are not recorded. They depend on internet connections and may not get through.
- Calls and messages in Visby are not for emergencies. In an emergency, call the local emergency number.
- We send ride offers and updates by WhatsApp or SMS. Reply STOP to stop texts (see the SMS Terms).
7. Getting paid
- Drivers are paid by the hotel or the guest, as agreed with the hotel. Visby doesn’t pay drivers. Your driver page can show how a hotel says it pays you, what it has recorded as owed to you and the payments it has recorded; those come from the hotel, so ask the hotel about your pay.
- Partners: if the hotel gives you a share of what a guest pays in the app and you add a bank account on your booking link, Visby pays that share into it on the hotel’s instruction, by bank transfer through its payout provider (currently Wise). Your share can be paid 7 days after the guest pays and once the booking has happened; Visby sends payouts once a month, early in the month (weekly until November 12, 2026). You confirm the bank account is yours or your business’s, and a transfer to the details you gave counts as paid. Until you add one, the hotel pays you directly. To change a saved bank account, email us.
- If a guest is refunded, or a card payment is disputed and lost, your share of that payment is reduced or taken back, from a later payout if it was already sent. If your bank account is in another currency, your share is converted at the payout provider’s rate when it’s sent; Visby pays the transfer fee, and fees your own bank charges are yours.
- We can’t pay anyone subject to sanctions, and we may hold a payout while we check suspected fraud or when the law, our payout provider or the hotel’s instructions require it. We may ask for information about you or your business that the payout provider needs to verify you.
8. Ending
You can stop at any time: stop accepting rides or bookings, and email us to remove your account. A hotel can stop working with you. We may suspend or remove your access to keep guests safe, after serious or repeated complaints, for fraud or misuse, or when the law requires it.
9. Liability
- You’re responsible for the services you provide and how you provide them. You’ll cover Visby for claims that come from your services, your driving or vehicle, or your breach of these terms or the law.
- Visby’s pages and tools are provided “as is”. We aren’t responsible for rides or services, for the hotel’s or guests’ actions, or for delays or failures of internet, messaging, calling or payment providers. Visby’s total liability to you under these terms is limited to CAD $100, except where the law doesn’t allow a limit.
10. Your data and changes
How we handle your information is in the Privacy Policy. We may update these terms; we’ll post the new date here and tell you on your driver or booking page before a change that reduces your rights takes effect.
11. Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario, without taking away protection you have under the mandatory laws of the country where you work.
