Terms of Service
These Terms govern your use of the Visby mobile application and related services (the “Service”). By creating an account or using Visby, you agree to these Terms and our Privacy Policy.
1. The Service
Visby is a travel companion: trip planning with friends, trip recaps you can share, learning content, games and collections, maps, optional Apple Watch features and optional in-app purchases. If you stay at a hotel that uses Visby, the hotel’s guest app and concierge run on Visby too. Features may change over time.
2. Eligibility & accounts
- Visby is for people 13 and up. You must be at least 13 to create or use an account, and accounts for anyone under 13 are not allowed. If you are under the age of majority where you live, you may use Visby only with the permission of a parent or guardian.
- If we learn an account belongs to someone under 13, we close it and delete its data.
- You must provide accurate signup information, including your birthday.
- You are responsible for keeping your login credentials secure.
- One person should not create accounts to evade bans or abuse limits.
3. Acceptable use
You agree not to:
- Harass, bully, exploit, or sexually solicit others
- Post illegal, hateful, or pornographic content
- Share others’ personal information without consent
- Cheat, hack, scrape, reverse engineer, or disrupt the Service
- Use Visby for medical, emergency, or professional advice (including HealthKit tips)
Zero tolerance. There is no tolerance on Visby for objectionable content or abusive users. Objectionable content includes harassment, bullying, threats, hate speech, sexual or pornographic content, anything that sexualises or endangers a child, graphic violence, encouragement of self-harm, scams and spam. You agree to these rules when you create an account, and they apply to everything you post or send: chat and board messages, photos, postcards, notes, names, songs, listings and anything else you share.
We may remove content, limit features, or suspend accounts that violate these Terms or create risk for other users. People who post objectionable content or abuse others are removed from Visby.
4. User content
You retain rights to content you submit (photos, messages, nicknames). You grant Visby a non-exclusive license to host, process, and display that content as needed to operate the Service. You are responsible for having rights to content you upload. Other users may see content you share in chat or social features. Use report and block tools when needed.
Reporting and blocking. You can report any message, photo, postcard, note, listing, profile or player from the Report option next to it, and block anyone so they can no longer chat with you, invite you or send you friend requests. Something you report is hidden from you straight away. We review every report within 24 hours, remove content that breaks these Terms and suspend or remove the accounts that posted it. You can see and unblock the people you blocked in Settings, under Safety & Family. You can also report something by email at hello@visbytravel.com.
Public recaps. When you publish a trip recap, anyone with the link can see the photos, places, map and story in it, and can save places from it. Only publish photos you’re allowed to share, and ask the people in them first. You can unpublish a recap at any time, and the link stops working. We show you how your recap is viewed (see the Privacy Policy).
5. In-app purchases & subscriptions
- Digital goods (Aura packs) and memberships are sold through Apple App Store and Google Play billing via Apple / Google.
- Prices are shown in the store sheet before you buy. Subscriptions auto-renew unless cancelled in your store account settings at least 24 hours before the period ends.
- Manage or cancel subscriptions in your Apple ID / Google Play subscription settings. Restoring purchases is available in Visby Settings.
- Consumable Aura packs are not restorable after use. Refunds are handled by Apple or Google under their policies.
- Aura you earn in Visby, including referral and invite rewards, has no cash value. We may change reward amounts and conditions at any time, and a reward may require qualifying activity (for example, the person you invited finishing onboarding or reaching a level) before it is paid.
6. Hotel stays and services
- At a hotel that uses Visby, the hotel (or a partner it works with, such as a tour or dive operator) provides your room and the services you book or buy. The hotel sets the prices, descriptions, availability and cancellation and refund rules, and delivers the services.
- When you pay in the app (or on a hotel’s Visby booking page) for a room, extra, meal, rental, ride or experience, you buy it from Visby: Visby buys it from the hotel and sells it to you, and the hotel or its partner provides it. Visby is the seller, so your contract for that purchase is with Visby, the checkout says “Sold by Visby”, and Visby is responsible to you for it being provided as described, or refunded under the hotel’s policy.
- Your card statement shows Visby with the hotel’s name. Payments are processed by Stripe; we never see or store your full card number.
- You pay in the currency shown. Your bank may charge its own fees or exchange rate. Some hotels add a Visby service fee when you pay in the app; if so, it’s shown with the price before you pay, and a full refund includes it. Things you put on your room bill or pay at the desk aren’t sold by Visby and have no service fee: they are between you and the hotel, and you pay the hotel directly.
- Refunds follow the hotel’s cancellation and refund policy, shown before you pay, and any rights consumer law gives you. Visby makes them to your card. Within free cancellation you can cancel a booking yourself in the app. If the hotel or partner can’t provide something you bought, they may offer you another time or something equal instead; you can take it or get a full refund, and if you don’t answer in time you’re refunded in full. For any problem with a service, contact the hotel first in the app; if it can’t be sorted out, email us before disputing the charge with your bank, and we’ll help.
- The concierge writes answers automatically from what the hotel has told it. Answers can be wrong, so check anything important (times, prices, safety) with the hotel.
- You need a Visby account to open a stay. The main guest can invite others to the same stay and decides who else may put things on the room bill.
7. Splitting trip costs and paying friends back
- Trip costs you add are split between the people on the trip. Visby does the maths, but you’re responsible for what you enter and for paying what you owe.
- You pay each other back outside Visby, in cash or with whatever you use (a bank transfer, PayPal and so on), and mark it paid in the app. Visby doesn’t take, hold or send money between friends.
- Visby isn’t a bank or a party to what you owe each other. Sort out mistakes with each other; marking something paid only updates the app.
8. Calls, messages and rides
- You can message and call your hotel, its drivers and partners in the app, over Wi‑Fi or mobile data. Your phone number and theirs are not shown to each other, and phone numbers, emails and links typed into ride chats are removed. Calls are not recorded.
- Calls and messages in Visby are not for emergencies. In an emergency, call the local emergency number. Calls depend on your connection and may not get through.
- Rides are arranged by the hotel with its own drivers or independent drivers it works with. Visby doesn’t provide transport and doesn’t employ drivers. The hotel and the driver are responsible for carrying out the ride; the price is the one the hotel confirms. When you pay for a ride through Visby, Visby sells you the ride (section 6) and refunds it if the ride isn’t provided. Wear a seatbelt and follow local law.
- When a driver shares their live location during your ride, you see it only for that ride.
9. SMS Terms (text messages)
Hotels that use Visby text their guests through us, and we text the hotel staff and drivers who work with those hotels. What we send:
- Hotel guests: a link to your stay before you arrive, the hotel concierge’s answers when you text the hotel, and updates on rides you booked.
- Hotel staff: verification codes you ask for while setting up your hotel.
- Drivers: ride offers and updates from the hotels you drive for.
- Consent: you get these texts because you gave your mobile number to the hotel when you booked, texted the hotel’s Visby number, asked for a code, or a hotel added you as one of its drivers. Consent is not a condition of any purchase.
- Frequency: message frequency varies. Most guests get one or two texts per stay, plus answers to the messages they send.
- Cost: message and data rates may apply.
- Opt out: reply STOP to any text. You will get one confirmation and no more texts. Reply START to turn them back on.
- Help: reply HELP, or email hello@visbytravel.com.
- Carriers are not liable for delayed or undelivered messages.
- We do not send marketing texts and never share your number for marketing. See our Privacy Policy.
10. Health, location & Watch features
Optional HealthKit and location features provide convenience and friendly wellness tips only. They are not medical devices or medical advice. Always location for Watch tips is optional. Do not rely on Visby for navigation safety, emergency response, or health decisions.
11. Intellectual property
Visby, our logos, game content, and software are owned by us or our licensors. You may not copy or redistribute our content except as allowed by the app’s normal use or with written permission.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Learning content is for entertainment and education, not professional advice.
Hotels, their partners and drivers, and services such as maps, payment, calling and messaging providers are run by others. We aren’t responsible for what they provide, for their delays or failures, or for automatically written answers and suggestions (for example concierge answers or suggested fares), which can be wrong.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISBY AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. MONEY YOU PAID A HOTEL THROUGH VISBY IS BETWEEN YOU AND THE HOTEL AND DOESN’T COUNT TOWARDS THIS AMOUNT.
Nothing in these Terms limits rights you have under consumer protection laws that can’t be waived, or our liability for fraud, or for death or personal injury caused by our negligence.
14. Account deletion & termination
You may delete your account at any time in Settings → Danger Zone → Delete account. We may suspend or terminate access for Terms violations or to protect users or the Service. Sections that by nature should survive (including IP, disclaimers, and liability limits) survive termination.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts where those laws allow it. Please email us first, so we can try to fix the problem.
16. Changes
We may update these Terms. We’ll post the new effective date here, and tell you in the app or by email before a change that reduces your rights takes effect. Continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
