Creator Partner Program Terms
These Creator Partner Program Terms (the “Terms”) are between Nomad Travel & Hospitality Inc., a company based in Ontario, Canada that operates Visby (“Visby”, “we”, “us”), and you, the creator taking part in the Visby Creator Partner Program (the “Program”). You accept them by clicking Accept in your creator dashboard. Your use of Visby’s website and apps is also covered by the Terms of Service and the Privacy Policy.
1. Definitions
- Dashboard: your creator dashboard at visbytravel.com/creators/dashboard.
- Referral: a hotel or other property you introduce to Visby, in your Dashboard, by an introduction email, or when the property signs up for Visby from your personal link.
- Approved Referral: a Referral that counts as yours under section 4. The property is then your Referred Hotel, and the day you make the Referral (or the day Visby sets when it adds one for you) is its Attribution Date.
- Qualifying Transaction: a purchase a guest makes and pays for through Visby’s checkout at a Referred Hotel on or after its Attribution Date, as described in section 5.
- Commission: what Visby pays you under section 5.
- Commission Schedule: the payout details shown in your Dashboard (when commission becomes payable, any minimum payout, and how payouts are made), which are part of these Terms.
- Qualifying Content: a post, Reel, TikTok, video, article or similar piece of content you publish that features or mentions both a Referred Hotel and Visby, with the disclosure required by section 8.
2. Joining the Program
- Anyone can apply. Visby decides whether to approve, waitlist or decline each application, and may take into account the quality of your content, your hotel relationships and fit with Visby’s brand. There’s no fee to apply.
- You must be at least 18 (or the age of majority where you live) and give accurate information. You may have one creator account.
- Once approved, you get a Dashboard and a personal link. You can refer hotels once you have accepted these Terms.
3. Referring hotels
- You can refer a hotel in your Dashboard, send its team an introduction email (the Dashboard gives you a draft to edit and send from your own email, with hello@visbytravel.com copied), or share your personal link. Visby never sends emails in your name.
- When you introduce a hotel, tell them you’re part of the Program and may earn a commission if they join. The introduction draft includes a line for this.
- Only share contact details of people you know or that the hotel has published for business enquiries, and only where you’re allowed to share them. Don’t send bulk or unsolicited messages in Visby’s name.
- Describe Visby accurately. Don’t promise a hotel prices, terms, results, revenue or anything else on Visby’s behalf. Visby and each hotel decide together whether to work together, on Visby’s terms for hotels.
- You stay free to pitch, work with and be paid by hotels for your own content and collaborations. The Program adds to that; it doesn’t replace it.
4. When a referral counts
A Referral counts as yours as soon as you make it in your Dashboard, or when the property signs up for Visby from your personal link, unless:
- the hotel was already live on Visby when you referred it; or
- another creator introduced the same hotel first, as far as Visby can tell from the records.
Your Dashboard tells you straight away when one of these applies. A visit to your link on its own is never a Referral. If you introduced a hotel some other way (for example by email) and it isn’t in your Dashboard, tell us at hello@visbytravel.com and Visby can add it for you.
Visby may still decline or end a Referral later when:
- the hotel is your own business or one you run or work for, unless Visby agrees otherwise in writing; or
- the Referral looks fraudulent or doesn’t meet these Terms.
Visby will tell you in your Dashboard and by email. If you disagree, email hello@visbytravel.com within 30 days with anything that helps (for example, your introduction email), and someone will look at it again. Visby keeps a record of every decision and the reason for it.
Referrals are tied to the property itself, not its name, so renaming a hotel doesn’t change who referred it. When a hotel you referred joins Visby with the same website, it’s matched to your Referral. Each property of a hotel group is its own Referral. If a hotel hasn’t joined Visby within 12 months of your Referral, Visby may close it, and you can refer it again later.
5. Commission
- The rate: 1% of the value of each Qualifying Transaction at your Referred Hotels. It’s a share of what the guest pays through Visby, not of Visby’s own earnings, and Visby pays it from its own share: hotels and guests are never charged extra for it.
- What counts: room bookings and deposits paid through Visby, dining, spa and wellness, transfers and transport, tours, excursions, activities, experiences and other services the guest buys through Visby’s checkout, at a Referred Hotel on Visby’s commission-based pricing.
- The value: what the guest pays through Visby for the purchase, less refunds, cancellations and chargebacks, and not counting Visby’s service fee, taxes shown separately, or tips.
- What doesn’t count: anything paid outside Visby (including the part of a room booking paid directly to the hotel, and bookings made through other websites or travel agents), fees a hotel pays Visby, test payments, and anything fraudulent. For hotels on a fixed monthly plan instead of commission-based pricing, any payment to you is set out in the Commission Schedule.
- When it starts: Commission counts on Qualifying Transactions from the Attribution Date. Visby will show what you’ve earned, what’s pending and what’s been paid in your Dashboard once commission tracking is switched on, worked out from Visby’s payment records.
- Currency: Commission is earned in the currency the guest paid in, and paid in your payout currency at the payout provider’s exchange rate on the day of the payout.
- Corrections: if a Qualifying Transaction is refunded or charged back after Commission on it was paid, the difference comes off your future Commission. Visby won’t ask you to pay money back, except for fraud or a serious breach of these Terms.
- Visby won’t lower the 1% rate on your existing Approved Referrals without your agreement.
6. Payouts and taxes
- Visby will pay Commission monthly once it becomes payable under the Commission Schedule, which Visby will publish in your Dashboard before your first payout. It may include a holding period (so refunds and chargebacks can settle) and a minimum payout; anything below the minimum rolls over to the next month.
- Payouts are made by bank transfer through Wise where it’s available in your country, or another way we agree. Visby pays its own transfer fees unless the Commission Schedule says otherwise. A payout counts as paid when the transfer completes; if it fails, Visby will pay again once you’ve fixed your details.
- You’re responsible for your own taxes on Commission. Visby may ask for tax details before paying you, and may withhold or report amounts where the law requires it.
7. How long Commission lasts
- There’s no fixed end date. You earn Commission on a Referred Hotel for as long as it stays active on Visby and you keep to these Terms for it, including the promotion below.
- One piece of content every 24 months: for each Referred Hotel, publish at least one piece of Qualifying Content within each 24-month period starting on its Attribution Date, and add the link in your Dashboard. One piece can cover the hotel and Visby together. You don’t need to visit the hotel again. Visby will remind you 90, 30 and 7 days before each deadline.
- If a deadline passes without Qualifying Content, Visby will tell you and give you at least 30 days to publish it. If you don’t, Commission on that hotel pauses: Commission earned before the pause is kept and paid, transactions while it’s paused don’t earn Commission, and it restarts from the day you publish Qualifying Content.
- If you stop taking part in the rest of the Program, you keep earning on your Approved Referrals as long as you keep meeting these Terms for them.
- Commission on a Referred Hotel ends if the hotel stops using Visby, closes, or ends its agreement with Visby. If it comes back to Visby more than 12 months later, it counts as a new hotel. Changes of name or ownership don’t end it while the property keeps using Visby. If the hotel moves to a fixed monthly plan, the Commission Schedule applies from then on.
8. Your content and disclosure
- Your content is yours, and you keep your editorial independence. Changing what you make or your niche doesn’t affect your Commission.
- Whenever you mention Visby in content, or recommend Visby to a hotel, clearly disclose that you’re a Visby Creator Partner and may earn a commission (for example “#ad”, “Paid partnership with Visby”, or “I earn a commission from Visby”), as the advertising rules where you and your audience are require.
- Only make claims about Visby that are true and that you can back up. Don’t quote results, earnings or performance Visby hasn’t given you to share.
- Visby gives you a limited, revocable permission to use the logos, screenshots and descriptions it provides, as provided, only to talk about Visby in the Program. Don’t suggest Visby employs you, don’t register domains, accounts or ads using Visby’s name, and don’t present yourself as Visby.
9. Fair play
Visby may decline Referrals, withhold Commission, or suspend or end your participation for:
- fake or self-referrals, fake engagement, or any attempt to game attribution;
- misleading claims, illegal promotion, spam, or failing to disclose your partnership;
- harassing hotels, guests or Visby’s team;
- conduct that seriously harms Visby’s reputation;
- misusing Visby’s brand; or
- any other serious breach of these Terms.
Before acting, Visby will tell you what’s wrong and, where it can be put right, give you at least 14 days to fix it. Visby can act right away for fraud or where waiting would cause serious harm. Commission tied to fraud or fake activity isn’t earned. Other Commission earned before a suspension or ending is paid as usual.
10. Information and privacy
- In your Dashboard you see your Referrals, their progress with Visby, and your Commission. You never see a hotel’s guests, their details or their bookings.
- Keep confidential anything non-public you learn about Visby or a hotel through the Program, and use it only for the Program.
- Visby handles your details, and the hotel contact details you share, under the Privacy Policy. You confirm you’re allowed to share any contact details you give us.
11. Our relationship
- You take part as an independent business or individual. Nothing in these Terms makes you Visby’s employee, agent or partner in a legal sense, and you can’t bind Visby to anything.
- Visby doesn’t promise that any hotel will join, how much any hotel will sell through Visby, or that the Program will lead to paid work. Visby may offer paid collaborations to creators it enjoys working with; those are agreed separately.
12. Changes and ending
- Visby may change these Terms or the Commission Schedule with at least 30 days’ notice by email and in your Dashboard. For material changes, you’ll be asked to accept the new version. Changes never reduce Commission you’ve already earned.
- You can leave the Program at any time by emailing hello@visbytravel.com. Section 7 explains how your Approved Referrals keep earning.
- Visby may end the Program with at least 90 days’ notice. Commission earned up to the end date is paid as usual.
- Sections 5, 6, 10, 13 and 14 (and anything else that by its nature should) survive the end of these Terms.
13. Liability
- Neither of us is liable to the other for indirect or consequential losses, or lost profits, except for fraud, breach of confidentiality, or amounts owed under these Terms.
- Apart from Commission owed, Visby’s total liability to you under these Terms is limited to the Commission it paid you in the 12 months before the claim.
- You’ll cover Visby for claims that come from your content, your messages to hotels, or your breach of these Terms or the law.
14. General
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute about them goes to the courts of Ontario.
- You may not transfer these Terms without our consent. We may transfer them to an affiliate or to someone who buys our business.
- We send notices to the email on your creator account and in your Dashboard. Send notices to hello@visbytravel.com.
- If any part of these Terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver. These Terms and the Commission Schedule are the whole agreement between us about the Program.
