Restaurant Partner Terms
These terms are between Nomad Travel & Hospitality Inc., a company operating out of Ontario, Canada that operates Visby (“Visby”, “we”, “us”), and the restaurant that accepts them (“you”). You accept them when you tick the box and save an offer on your private Visby preview page. They cover the offer you set there and every booking Visby takes for it.
1. What Visby does
- Visby selects independent restaurants for its guide and shows your offer (the dishes, the price and the times you set) to Visby’s hotel guests and travelers in the Visby app and on Visby pages.
- Visby takes the guest’s payment, confirms each booking and emails you the details, including the guest’s name, the date, the party size and a redemption code.
- Visby doesn’t cook, serve or run your restaurant, doesn’t employ you, and doesn’t promise any number of bookings. You’re free to work with other platforms.
- Your offer stays a private preview until Visby confirms it with you and marks it live. Visby may decline to publish an offer, for example one that bundles alcohol where that is not allowed.
2. Your offer
- You choose the dishes, the price, how many bookings you can take per day, and the dates it is not available. You can change or pause it by emailing us; changes apply to bookings made after we confirm them.
- You serve what the offer describes, at the quality you normally serve, to every guest with a valid booking on an available day. You hold the licences, permits and insurance your restaurant needs, follow food safety and alcohol law, and tell guests about allergens as the law requires.
- You’re responsible for the taxes on what you earn, and for any tax that must be shown on the guest’s bill.
3. Commission and what you get
- There is no setup fee and no monthly fee.
- Visby charges a commission of 15% of what the guest pays, only when someone books. You get 82% of the price, less card processing (about 2.9% + 30¢, the payment processor’s list rate). The rest of the price is Visby’s, including what Visby pays to bring you guests.
- Your private preview page shows the exact amount you get per booking at the price you set.
4. Payouts
- Visby pays what you get for a booking 7 days after the guest’s visit, by bank transfer in your restaurant’s currency, through Visby’s payout provider. Visby sends payouts in batches; a booking that becomes payable is included in the next batch.
- You give us a bank account in your restaurant’s or business’s name and confirm it is yours. A transfer to the details you gave counts as paid. To change a saved bank account, email us.
- Visby pays the transfer fee. Fees your own bank charges are yours. We can’t pay anyone subject to sanctions, and we may hold a payout while we check suspected fraud, or when the law or our payout provider requires it. We may ask for information the payout provider needs to verify you.
5. Redemption codes
- Each booking has a redemption code. Check the code when the guest arrives and serve the offer once per code. A code is valid only on the booked date or within the dates shown in the booking email, and not on your blackout dates.
- Visby pays only for codes that were valid when served. If you serve a guest without checking the code, or serve a code twice, Visby doesn’t owe you for the extra meal.
6. Refunds, cancellations and no-shows
- If a guest cancels within the cancellation window shown to them when they book, Visby refunds them and nothing is owed to you.
- If a guest doesn’t show up and doesn’t cancel in time, the booking counts as used and you’re paid as if they came.
- If you can’t serve a confirmed booking (you’re closed, full, or the offer isn’t available), tell us as soon as you know. The guest is refunded and you aren’t paid for that booking. If it happens often, we may pause your offer.
- If a guest is refunded because the offer wasn’t served as described, or a card payment is disputed and lost, your share of that payment is reduced or taken back, from a later payout if it was already sent.
7. Data
- Use guests’ details only to serve their booking. Don’t market to them or keep their details afterwards unless they give them to you directly.
- Visby uses your restaurant’s public information (name, menu, photos and contact details from your own website) and what you enter on your preview page to run the guide, take bookings and pay you. How we handle personal information is in the Privacy Policy.
- You let Visby show your restaurant’s name, menu items and photos you provide or publish on your website, alongside your offer, for as long as the offer is listed.
8. Term and ending
- These terms start when you accept them and continue until either of us ends them. You can end them at any time by emailing us; Visby removes your offer within 2 business days.
- Visby can end them or pause your offer with notice by email, or straight away for fraud, serious or repeated guest complaints, food safety concerns, or when the law requires it.
- Bookings already confirmed when the terms end are still served and paid under these terms, unless the guest is refunded.
9. Liability
- You’re responsible for the food, drink and service you provide. You’ll cover Visby for claims that come from them, or from your breach of these terms or the law.
- Visby’s pages and tools are provided “as is”. We aren’t responsible for guests’ actions, or for delays or failures of internet, email or payment providers. Visby’s total liability to you under these terms is limited to what Visby paid you in the 3 months before the claim, or CAD $100 if that is more, except where the law doesn’t allow a limit.
10. Changes
We may update these terms; we’ll post the new date and version here and email you at least 14 days before a change that reduces what you get or your rights takes effect. If you keep your offer listed after that, the new terms apply.
11. Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario, without taking away protection you have under the mandatory laws of the country where your restaurant operates.
