Tour Operator Terms
These terms are between Nomad Travel & Hospitality Inc., a company based in Ontario, Canada that operates Visby (“Visby”, “we”, “us”), and the tour or activity company that accepts them (“you”, the “Operator”). You accept them for your business when you click Accept in your Visby desk. Hotels have their own Partner Terms, and referring hotels to Visby is covered by the Industry Partner Terms.
1. What Visby does for you
- A public Visby page for your business with your tours, rentals and packages, bookable online, and your tours listed in the Visby app and in the guest apps of hotels and stays that work with Visby.
- A desk (admin.visbytravel.com) to manage your offers, clients, custom trips and bookings, and a client app your customers open from a link: their booked tours day by day, messages with your team, photos and a trip recap video with your logo they can share.
- Visby can set up your page and offers from your website. Nothing goes live until you’ve approved it, and you can change or remove any offer in your desk at any time.
2. Your tours
- You run the tours and activities, and the contract for each tour is between you and the customer. Visby doesn’t provide tours, transport or activities and doesn’t employ your guides.
- You keep your listings accurate (what’s included, times, meeting points, prices, age or health limits, cancellation policy) and hold the licences, permits and insurance your tours need.
- You’re free to sell anywhere else (your website, Bókun, Viator and others) and to take payment any way you like outside Visby.
3. What Visby charges
Visby charges a share of what the customer pays for a booking made through Visby:
- Bookings Visby brings: 15%, all-in. A customer who books on Visby’s site or app, or in the guest app of a hotel or stay that works with Visby. Card processing is included: Visby pays it out of its 15%. When a partner hotel’s guest books, the hotel’s share comes out of Visby’s 15%, never on top of it.
- Your own sales through Visby: 3% plus card processing. A customer who books through your own website (a Visby booking widget or button on it), a booking link you share from your desk, or a client you added to your desk. Card processing is 2.9% + US$0.30 per card payment, so about 6% in all on a typical booking.
- Sales outside Visby: 0%. Payments by Zelle, cash, your own card processor, Bókun, Viator or any other channel aren’t charged by Visby.
Each booking in your desk shows which of these it is and what Visby keeps. Please don’t ask a customer who booked through Visby to cancel and rebook with you directly.
4. Promo codes
You can give Visby a promo code with a discount you fund (for example 5% off), to use in Visby’s marketing so you can track the sales it brings. The discount comes off your price, and Visby’s share is worked out on what the customer pays after the discount. You can end a code at any time; bookings already made with it keep their price.
5. Getting paid
- When customers pay by card through Visby, Visby collects the payment for you as your limited payment collection agent: once the customer has paid Visby, they’ve paid you. Until card payments are switched on for your desk, bookings come to you as requests you confirm and take payment for yourself.
- Visby pays you the price less Visby’s share (and card processing on your own sales), by bank transfer through its payout provider (currently Wise), to the account you add in your desk. A booking can be paid out 7 days after the customer pays and once the tour has happened. Payouts go out once a month, early in the month. Visby pays the transfer fee; fees your own bank charges are yours.
- We can’t pay anyone subject to sanctions, and we may hold a payout while we check suspected fraud or when the law or our payout provider requires it. We may ask for information about your business that the payout provider needs to verify you.
6. Cancellations, refunds and disputes
- Your cancellation policy is shown to the customer before they book, and refunds follow it. If you cancel a tour (weather, safety or anything else), the customer gets a full refund or another date they accept.
- On a refund, Visby returns its share of the refunded amount. On your own sales, card processing on the original payment isn’t returned.
- If a customer disputes a card payment, Visby answers the dispute with the booking record and anything you send us. If the dispute is lost because the tour wasn’t provided as booked, the amount is taken back from a later payout. Otherwise Visby covers it.
7. Customers and their information
You get the details of customers who book you (name, contact, party, answers to your questions) to run the tour and follow up with them as the law allows, including asking for reviews. Visby doesn’t sell your customers’ information or give it to other tour companies. How Visby handles personal information is in the Privacy Policy.
8. Your name, photos and content
You let Visby use your business name, logo, photos and tour descriptions to show and sell your tours, on its site, apps and partner guest apps. Visby only announces the partnership (for example on LinkedIn or social media) with your approval of the post. You confirm you have the right to the content you give us; you can ask us to remove any of it.
9. Ending
There’s no minimum term. Either side can end these terms with 30 days’ notice by email. Bookings already made are honoured and paid as these terms say. We may pause your listings straight away to keep customers safe, after serious or repeated complaints, for fraud, or when the law requires it.
10. Liability
- You’re responsible for your tours and how you run them. You’ll cover Visby for claims that come from your tours, your staff, vehicles or boats, or your breach of these terms or the law.
- Visby’s pages and tools are provided “as is”. Visby’s total liability to you under these terms is limited to the amount Visby kept from your bookings in the 12 months before the claim, except where the law doesn’t allow a limit.
11. Changes
We may update these terms. We’ll post the new date here and email you at least 30 days before a change to what Visby charges takes effect; you can end these terms before then.
12. Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario.
